Supreme Court decision on lawsuit against Remingto

Post by noname »

I just saw a blurb about this. Don't know if it is true or not considering news reporters. Suits can be allowed resulting over the Sandy Hook incident. Said people could sue Remington. My concern is this could lead to lawsuits against other gun makers for other shootings setting a precedent. A slippery slope.

Opens the door for law suits against auto manufacturers when they use a vehicle to kill allot at once. Bunch of crap as far as I am concerned.

This is misreported in most news sources. There was no Supreme Court decision. They just didn't hear the appeal from the CT supreme court.

Exactly, the law passed in 2005 protecting firearm manufactures had exceptions. One of which was how the firearm (in this case Bushmaster ) was advertised. Never mind that a kid with real mental issues stole it from his mom, and murdered her to. But I digress,
The exception mentioned above seems to be the lane the lawsuit is taking. Don't think that will wash all the way up the ladder.
Don't matter, lawyer's getting rich.

agree with rebel. the "decision" was simply a decision to not hear an appeal on something that hasnt happened yet - that namely being remington was successfully sued.

as noted, at least as best as i understand it - they are being sued for their ADVERTISING/Marketing tactics and not actually being liable for the actions of the shooter.

we'll have to see how it plays out in court, and i suspect if a judgement is rendered against Remington/bushmaster that will be the time the supreme court makes an actual decision to hear the case.

hopefully by then RBG will have been replaced due to health issues with a solid conservative and we can shut the door on these kind of frivilous lawsuits once and forever.

Thanks for the much more clear reporting on the procedural history. Frankly I doubt they want a decision which would be clearly erroneous application of the law. That statute is relatively straightforward so to directly go against it would be a decision that could be overturned in basically any Court upstream. Probably with censure for the judges involved.they get more mileage turning it into a misreported headline than actually following through with it.

This nonsense has got to stop. They should sue alcohol suppliers, for the stupid crap drunk people do, and the car manufacturers for accidents resulting in property damage, injuries, and fatalities. Might as well sue food producers for causing people to be overweight too.

This is a replay of one of the news articles I saw. Seems the use of the term "supreme court" and "US Supreme Court" are quoted and used interchangeably by some news outlets, whether it is state or federal. The news article I originally saw was a selective quote of lines from the attached news article. News lately seems more about shock appeal than relaying truth. There is a big difference in the weight of the decision state vs federal. Notice also this is a left leaning npr source. https://www.npr.org/2019/11/12/77848792 ... to-proceed

My personal opinion is most news comes from progressive (note the use of the moniker liberal is not as popular with the masses as the term progressive) and tends to be sources from big cities like New York City that know little if anything about firearms. Any semi-automatic is now called an "assault rifle, shotgun, etc."
